Thanks to Hurricane Beryl, yesterday's hearing was postponed. But today, I was able to admit one Will and have heirs declared in another matter. If you need either services, please let our office know. Kathleen and I handle these matters.

Do you need a trust? Yes, no or maybe... The answer is that we need to evaluate your situation. There is NO Texas inheritance tax. Right now, the federal inheritance tax does not kick in until your estate is OVER $13.7 million. Does a trust create liability protection? If it is IRREVOCABLE, but then you lose the ability to manage/change during your lifetime. If you are a Texas resident with less than $13 million, there may still be reasons to consider a trust.... 1) you want your child to receive a benefit but s/he has a drug issue so you don't want her/him to receive all at once 2) your beneficiary has a gambling problem, so again, you don't want him/her to receive all at once 3) your child is a minor (or not yet "mature enough") 4) your beneficiary is receiving government benefits and you do not want them to be disqualified. These are some of the reasons to discuss the need/desire for a trust. Probate in Texas is not horrible. Probate is not the end of the world. And if you pick the right attorney (and live in the right counties) you can be done relatively quickly. If you have questions, do not hesitate to contact Kathleen or Pam at 713-995-8200.

Did you know.... If you gave a child up for adoption and die without a Will in Texas, that child is entitled to inherit a portion of your estate. And the court-appointed ad litem has to ask these hard questions of your witnesses. Affairs? Children outside marriage? Adoptions? All topics of concern.

Pam Keever serves on the Board of Houston's Amazing Place. AP is a non-profit organization that assists all in dealing with mild to moderate dementia. If you are a caregiver of someone with dementia or Alzheimer's or if you just know of someone who seems to be having issues, AP can provide assistance and outreach.

Don't leave real property to a minor! The minor cannot contract to sell and a parent or guardian cannot sell without a court order --- not even the natural parent of the minor. Make sure that you plan properly!!! Lack of a Will from a parent or grandparent can cause time, money and headaches when a minor inherits. If you need to discuss this type of planning, call our office.

Monday - Kathleen had two probate hearings for mom and aunt of client; Tuesday - Pam had two probate hearings for a mom and dad of client; Wednesday - Kathleen had a hearing where she was the ad litem. And we have closed 8 title files in the last week and worked to clear issues on 3 others that will close in the next week. We love our clients and we like staying busy!

PSA: If you have a small business (LLC, PLLC, Inc., LP) that is not publicly traded, you are subject to the Corporate Transparency Act. If your company was formed prior to January 1, 2024, you have until the end of 2024 to register (wwwfincen.gov/boi). If you file a new company in 2024, you have 90 days from formation to register. If you file a new company or or after January 1, 2025, you will have 30 days from formation to register.
