Congratulations to Gregor Wynne Arney attorneys Michael Wynne and Jon Muschenheim who were recognized by the Texas Criminal Defense Lawyers Association as Champions of the Month.

Shout Out to Michael Wynne and Jon Muschenheim! Wynne was lead counsel and Muschenheim was second chair. On November 22, 2024, a federal jury in Newark, New Jersey, returned a favorable defense verdict for their client, acquitting him on six counts related to healthcare fraud and violations of the federal anti-kickback statute. The jury could not reach a verdict on the nine remaining counts. The government moved to dismiss the remaining counts on January 14, 2025. Bravo!

Boeing 737 Max deal rejected by judge on DEI clause. Michael Wynne speaks with Law360.
Texas federal judge, Reed O’Connor, of the U.S. District Court in Fort Worth, rejected Boeing’s plea agreement, with the U.S. Department of Justice. Reed pointed to two major issues: the DOJ’s policies of considering diversity, equity and inclusion when selecting an independent compliance monitor, and the court’s “erroneously marginalize[d]” role in picking and overseeing that monitor. The judge gave the DOJ and Boeing 30 days to rework how they plan to proceed.
Michael Wynne, partner and white collar criminal defense attorney with Gregor Wynne Arney PLLC, said rejecting the plea agreement was “absolutely the correct decision” and that “30 days, based on my experience, is more than enough time to redraft the documents to comply with the court’s instructions.”
“It should not be difficult … you can do it and there’s absolutely no excuse not to do it in 30 days,” he told Law360 in a recent interview.
“While there may be a place for DEI considerations in various parts of the government, this is not the place,” Wynne added. “Most critical here is the public perception and the actual fact that ongoing maintenance and compliance will be the safest and best possible. … This [is an] effort to include a provision that must’ve been pushed by some ivory tower idealist with no experience in the real world. The judge, thank God, short-circuited an agreement that was going to cause huge problems in the future.”

Regarding Pardoning of Hunter Biden – Who Would Cast the First Stone?
I am a life-long Republican and I support President-Elect Trump. I’m also a father. Joe Biden lied when he said he would never pardon his son Hunter. Full stop. But who believed him or did anything in reliance on that pledge? No one. Full stop.
Biden lost his first wife and a daughter years ago and then lost a promising son in the prime of his age, who was serving as Delaware’s Attorney General.
Biden’s public career is over and, with respect, he is in the twilight of his years. What’s most important in life when one reaches that point?
Show me a Republican who would not have done the same thing as his or her presidency and career came to an end, and I’ll show you a liar and someone for whom I would not vote.
The purposes of criminal justice system are four-fold: (1) punishment; (2) specific deterrence – meaning to deter the defendant from committing another crime; (3) general deterrence – meaning to discourage other people from committing the same or similar crimes; and (4) rehabilitation.
We say, “you can beat the rap, but you can’t beat the ride.” Enduring federal criminal prosecution and public shame is punishment. Enough for what he did, who is to say?
It is evident that Hunter is unlikely to be committing another crime.
It is also evident that whatever deterrent value his prosecution serves for others inclined to commit the same crimes, the point has been proven.
Finally, it appears that Hunter has undergone rehabilitation, and it is unlikely that the federal prison system will help him further rehabilitate.
I won’t touch allegations of abuse of prosecutorial discretion or political motivations for the prosecutors’ pursuing the charges or whether such charges would have been brought had Hunter Biden not been Joe Biden’s son. Those considerations are irrelevant.
The pardon is emblematic of human behavior. So, let’s get off our high horses. The rule of law will not collapse.
