In Arizona, divorce proceedings operate on a no-fault basis, eliminating the need for either spouse to prove fault or wrongdoing. This approach aims to streamline the process, potentially saving time and reducing legal expenses. It can also reduce emotional stress for both parties involved. Going through a divorce or separation is difficult for the entire family, especially the children. As you navigate this transition or begin to create a divorce plan, it's important to prioritize your kids' well-being. What kind of parenting plan would be best for your children? What would help them feel safe, loved, and properly cared for?
The more you prepare, the less daunting the divorce process becomes.

What happens when the other party is delaying the divorce settlement process? Whether the other party is delaying the divorce process by being non-responsive, having significant delays in responses, or generally just being difficult, you could request that the court sanction the other party. This momentary sanction would allow you to recoup the amount you've had to incur from your lawyer based on their delay. That said, monetary sanctions are within a judge’s discretion and are something you should discuss with your lawyer before you request them.

Communication with your coparent during divorce and after can often be a struggle. High emotions, differences of opinion, and so much more can make it hard to have effective communication. I always recommend that my clients read BIFF by Bill Eddy, Annette T. Burns, and Kevin Chafin. It's a great tool that will help you learn how to navigate challenging conversations easily and respectfully.

On February 8 and 9, Kelly and I had the privilege of attending the Family Law Institute, which is co-sponsored by the Arizona State Bar and the American Academy of Matrimonial Lawyers. During this conference, we discussed important financial and child-related issues during a divorce. My favorite part was the rule and case law updates. These events give me the opportunity to stay up to date on the ever-changing legal field so I can make sure my clients have the most current information when making legal decisions.
