📌 Legal Tip of the Week: Limiting social media activity during a personal injury case is advisable for several reasons:

⚖️Preservation of Evidence: Anything posted on social media could potentially be used as evidence in your case. Even seemingly harmless posts or photos could be misconstrued or taken out of context by the opposing party to discredit your claim.

⚖️Privacy Concerns: Your privacy on social media platforms is not guaranteed. Even if your account is set to private, there's still a risk that your posts could be accessed or shared without your consent, potentially harming your case.

⚖️Avoiding Misinterpretation: Social media posts are often open to interpretation, and what you intended as a harmless update could be viewed differently by insurance adjusters, opposing attorneys, or jurors. It's best to avoid any ambiguity that could be used against you.

⚖️Protecting Your Reputation: Posting about your activities or lifestyle during a personal injury claim could be seen as inconsistent with your reported injuries or limitations. This could undermine your credibility and weaken your case.

⚖️Legal Advice: Kenny & Stinson may advise you to refrain from social media activity to protect your legal interests. They can provide guidance on what is appropriate to post and what should be avoided during the duration of your case.

⚖️Preventing Emotional Outbursts: Social media can be a platform for expressing emotions, but during a legal proceeding, it's crucial to maintain composure and avoid saying or posting anything impulsively that could be detrimental to your case.

In summary, limiting social media activity during a personal injury case helps protect your privacy, preserves evidence, maintains your credibility, and prevents potential harm to your legal interests. It's best to err on the side of caution and refrain from posting until your case is resolved.

📌 Legal tip of the week. With summer comes parties, BBQs, and get togethers. Here are some tips for social host liability. Stay aware! Protect yourself!

In New Jersey, social host liability laws can hold you responsible if you provide alcohol to a minor or if you serve alcohol to an adult who is visibly intoxicated, and they subsequently cause harm to themselves or others as a result of their intoxication. These laws are intended to encourage responsible alcohol consumption and help prevent alcohol-related accidents and injuries.

Under New Jersey law, if you knowingly serve alcohol to a minor or a visibly intoxicated person in your home and they cause harm as a result of their intoxication, you could potentially be held liable for damages. This liability can extend to injuries sustained by the intoxicated person themselves, as well as injuries or damages caused to third parties, such as in cases of drunk driving accidents.

It's important to note that New Jersey's social host liability laws are nuanced, and liability can depend on various factors, including the age of the individual, their level of intoxication, and the circumstances surrounding the alcohol service. Consulting with a knowledgeable attorney who is familiar with New Jersey's laws and regulations regarding social host liability can provide you with personalized guidance and help you understand your rights and responsibilities as a host.

Kenny & Stinson wishes our clients and friends of the firm a safe and Happy Memorial Day 🇺🇸weekend. Read on for some important tips.

📌 Tips to ensure a safe Memorial Day weekend:

🇺🇸Stay Informed: Be aware of any travel restrictions or advisories in your area or your planned destination. Keep up with the latest news for travel notifications and safety measures.

🇺🇸Travel Safely: If you're traveling, whether by car, plane, or any other means, make sure your vehicle is in good condition. Follow all traffic laws, wear seatbelts, and avoid distractions while driving.

🇺🇸Sun Protection: If you're spending time outdoors, especially if you're going to the beach or having a barbecue, remember to apply sunscreen regularly to protect your skin from harmful UV rays.

🇺🇸Stay Hydrated: Especially if you're spending time outside in hot weather, drink plenty of water to stay hydrated. Avoid excessive alcohol consumption, as it can lead to dehydration and impair judgment.

🇺🇸Water Safety: If you'll be near water, whether it's a pool, lake, or ocean, always supervise children closely. Make sure everyone knows how to swim, and if you're boating, ensure that life jackets are worn by everyone on board.

🇺🇸Grilling Safety: If you're planning to barbecue, make sure your grill is in good working order and set up in a safe location away from structures and overhanging branches. Never leave the grill unattended while it's in use.

🇺🇸Fire Safety: If you plan to have a bonfire or fireworks, be extremely cautious. Follow all local regulations regarding fireworks and keep a bucket of water or a hose nearby in case of emergencies.

🇺🇸Designate a Driver: If alcohol will be involved in your celebrations, plan ahead and designate a sober driver or arrange for alternative transportation such as a taxi or rideshare service.

🇺🇸Be Mindful of Others: Remember the significance of Memorial Day and be respectful of those who have served in the military and their families. Avoid disruptive behavior and be considerate of your neighbors and fellow citizens.

By following these tips, you can help ensure that you and your loved ones have a safe and enjoyable Memorial Day weekend. HAVE FUN!🥳

⚖️Legal Tip of the Week: Social Media ⚖️

This tip holds immense significance! In today's era, where a majority of individuals engage in various forms of social media such as Facebook, Instagram, and others, exercising caution in your online activities becomes crucial, especially when dealing with an ongoing personal injury case. Insurance companies and defense attorneys actively seek access to your social media content, particularly photos and videos, during the course of a pending case.

Regardless of whether a photo or video was captured prior to your accident and only recently posted, if it depicts activities inconsistent with claims of injury, it can pose a significant challenge. Proving the timing of the content may be difficult, and it can cast doubts on your credibility. These posts are prone to misinterpretation and can be highly detrimental to your case for seeking monetary damages. Consequently, it is strongly advised to refrain from posting photos or videos on your social media accounts while your personal injury matter is pending, as it can adversely impact the outcome of your case.

👨🏻‍⚖️ CASE CLOSED! 👨🏻‍⚖️ Congratulations to Charles F. Kenny for obtaining a settlement of $237,500.00 in a pedestrian fall down case. Our client was walking in a park when he tripped on a raised sidewalk slab and fell. The city aggressively defended the claim relying on the many immunities from liability designed to protect public entities. The defense made two motions to dismiss the case based on these immunities. Fortunately, the Judge denied the motions and found the defendant liable for the incident as it allowed a dangerous condition to remain at the premise in violation of Title 59 of the NJ Tort Claims Act resulting in injuries to our client. Our client, an older gentleman, suffered injuries to his neck, back, shoulder and knees. He ultimately required shoulder and knee surgery. He also had pre-existing injuries which required medical treatment. The case was litigated for 2+ years and settled prior to trial for $237,500.00. The result exceeded our client’s expectations. We are so happy for him!

⚖️LEGAL TIP OF THE WEEK ⚖️ PRIORITIZE YOUR DOCUMENTS!

As we welcome the new year, it's crucial to prioritize the organization and security of essential documents. In these unpredictable times, safeguarding the future of ourselves and our loved ones is more important than ever, as we never know what tomorrow may bring.

To ensure peace of mind and preparedness for any eventuality, consider creating and maintaining these three key documents:

Last Will & Testament: This vital document outlines your final wishes regarding the distribution of your assets and the care of any dependents after your passing. It appoints an executor or executrix, who is responsible for ensuring that your wishes are honored, thus providing clear guidance to your loved ones during a challenging time.

Living Will: A Living Will is essential for guiding your healthcare decisions in the event that you are unable to communicate them yourself due to medical incapacitation. This document designates a health care representative to make decisions aligned with your preferences regarding treatment and end-of-life care, ensuring your well-being is managed as you would wish.

Power of Attorney: This document is crucial for financial preparedness. It appoints an agent to manage your financial affairs, including paying bills and making investment decisions, should you become incapable of handling these responsibilities. This helps in avoiding any financial complications or burdens that could arise during periods of incapacity.

Having these three documents in place is not just about protecting yourself; it's also about safeguarding your loved ones. They provide clarity and direction, alleviating the stress and uncertainty that can accompany the management of medical and financial affairs during times of loss or incapacity. By taking these steps, you are not only organizing your affairs but also demonstrating care and consideration for those you hold dear.

⚖️Legal Tip of the Week⚖️ Automobile Insurance: Do not select private health insurance as primary for payment of medical treatment

You must pay attention and do your research when searching for or renewing your automobile insurance policies. As NJ is a no-fault state, when you are involved in an automobile accident, your automobile insurance pays your medical bills regardless of whom is at fault. However, there are agents who will tell you that you can select your private HEALTH INSURANCE as primary insurance on your automobile policy to save a “few dollars” on your automobile insurance premium. This means when you suffer injuries in an automobile accident and need medical treatment you must provide your private health insurance card to your medical providers.

Our advice? Do NOT select your private health insurance as primary on your automobile insurance policy. We are often told by clients that they had no idea what this meant but selected it only because they were told it saves them a “few dollars” on their premium. What they were not told is that if they have terrible health insurance, that is the insurance they must use when seeking medical treatment for their automobile related injuries. Not good!

Also, what they were not told is that some private health insurance companies assert liens for monies paid for automobile related injuries. Where do you think the money comes from to pay back the health insurance lien??? YOU! Payment of liens is deducted from your settlement proceeds.

To avoid this, always select your automobile insurance as primary insurance when involved in an automobile accident!

👩🏻‍⚖️ CASE CLOSED!!! 👩🏻‍⚖️ Charles Kenny is pleased to announce a $1,450,000.00 settlement for our client who was a passenger in a vehicle when his vehicle was struck by another vehicle resulting in physical injuries. We fought hard to prove that the drivers of both vehicles were inattentive and driving in an unsafe manner. Our client suffered injuries to multiple body parts and was required to have two operations. He suffered from pain with bending, sitting, walking, and standing. He was out of work for 3 months. The case was heavily litigated and ultimately submitted to mediation. After an entire day of negotiations, the case settled for $1,450,000.00. Our client is extremely satisfied with the results and our firm’s representation. He is thrilled to put this matter behind him.
